Care and Treatment
1. Notification of Resident District within one business day to request transcript and special education records.


A record must be maintained for all students who enter the facility for each school year.  The following information must be recorded:


(1)  Date student entered facility.
(2)  Date (within 1 business day) the school records (ie., transcript) including special education record (i.e., IEP, ESR) were requested.  The resident district is required under special education rule to fax the records within 2 business days of receiving the request.
(3)  For student who attended SPPS, the clerk will look up the last school attended on Campus.
(4)  The compliance monitor will fax the records to the clerk within 2 business days.
(5)  Date that the records were received.


2.  Education services will be provided within 3 business days after the student enters the facility.  The first four days of the student's placement may be used to screen for educational and safety issues.


(1)  If the student does not have a disability then the student will receive regular education services.   For a student who has not been identified as having a disability, a screening must be conducted at the facility as soon as possible to determine the student's educational and behavioral needs and must include a review of the student's educational records.


(2)  If no special education records are received from the resident district and there is no other indication that the student has a disability, the student will be treated as a regular eduction student.  However, if there is a suspected disability (e.g., old special education records, parent reports that the student had special education, etc.), the child study team must conduct an evaluation to determine if the student does have a disability.


3.  IEP Team Meeting


(1)  If the student has a disability, an IEP team meeting must be called as soon as possible to write an IEP for placement in the facility and determine if additional evaluation information is needed.


The following people must be invited to the IEP team meeting:
(a)  Person or agency placing the student in the correctional facility;
(b)  Representative from the resident school district;
(c)  Appropriate teachers and related services staff form the facility;
(d)  Parent/legal guardian.
(e)  Student, when appropriate.


Reminder:  The IEP Manager must make 2 documented/logged attempts to remind the parent of the IEP team meeting.  If the parent does not attend, the IEP meeting should still be held and an IEP developed.  Be sure that an administrator or designee is present.


The new IEP should be sent to the parent with the "Notice of Proposed Special Education Services".  If the parent does not respond, the IEP can be put into action after 14 calendar days.  Even if the student is only anticipated to be placed in the correctional facility for a short-term (e.g., less than 15 days), an IEP team meeting should still be called.  If the student leaves the facility before the IEP team meeting can be held, the IEP meeting can be cancelled an no IEP needs to be developed.  Be sure to log this information in the "Contact Log".


The IEP should address the following:


(1)  Record the services on the IEP based on the disability (e.g., EBD, OHD, SLD, etc.).  Do not use "BTT Handicapped" for the service.  Record the minutes per day that the studet will receive the service.  Record any related services that are necessary for the student to meet IEP goals and objectives.


(2)  Write an LRE statement that indicates the reasons that the student's needs must be met in the Feral Setting VI (Public Residential).  Do not include any private student data in the statement.


Sample LRE statement:


(Student) was placed in a correctional facility by the court due to illegal activity in the community.  (Student) receives individualized academic support and behavioral services in a classroom setting that includes nondisabled peers.


(3)  Review the IEP and determine whether the goals and objectives from the current IEP can be carried out or if new goals and objectives need to be developed for the correctional setting. 


4.  Services


(1)  Student must receive a full day of school unless the student has unique needs that must be documented in the IEP or educational records in consultation with the treatment providers.


(2)  Summer school must be provided for students who are not preforming at grade level.


5.  Exit Reports


(1)  For students who are placed in the facility for 15+ business days, the IEP manager must prepare an exit report that includes:


(a)  A progress report;
(b)  Service information;
(c)  Evaluation information;
(4)  IEP for students with a disability.


(2)  The report must be sent to:


(a)  Resident district;
(b)  Next providing district if different than the resident district;
(c)  Parent/legal guardian;
(d)  Any appropriate social service agency.
