Behavior - Due Process Procedures (for all disability areas)
All students receiving special education services regardless of the disability have protection under federal and state laws when behavior problems occur. This section details the due process steps that must be followed when a student with a disability displays a significant behavior problem that results in dismissal or suspension. The requirements for an Emergency Use of a Conditional Procedure and conducting a Manifestation Determination are also included.

This section also provides information about when a Functional Behavior Assessment must be completed and instructions for completing it.

Finally, this section provides instructions and legal restrictions on the use of "Conditional Procedures" and how to include a behavior intervention plan in an IEP.
